Alex specialises in local authority prosecutions and all aspects of regulatory and criminal work both for defendants and prosecution authorities.

Alex prosecutes on behalf of local authorities throughout Wales and England in conjunction with the Federation Against Copyright Theft (FACT), British Recorded Music Industry (BPI); Welsh Illegal Money Laundering Unit, Scambusters and Natural Resources Wales. Alex also prosecutes fatalities under HSE legislation on behalf of local authorities.

He regularly lectures and provides practical workshops on all aspects of regulatory work to LAs, Scambusters, NRW and other prosecuting agencies.

Alex is a CPS Grade 4 prosecutor and is an Attorney General’s HSE prosecuting advocates panel member.

  • Notable Cases
    • R v Whitehead and others Truro CC 2018: prosecuting a conspiracy involving the largest haul of counterfeit goods seized by Cornwall County Council. Local postmaster Mr Whitehead operated an unlawful internet business worth millions of pounds importing car badges and other goods from China. The defendant and his co-conspirator operated from a warehouse and involved third parties to set up internet sites to avoid detection. POCA ongoing;
    • R v Mundy CA (2018) EWCA Crim 105: police undertook internet searches to establish that the defendant’s home had increased in its equitable value. Defendant working legitimately for years and there was no suggestion the monies were the proceeds of crime. Section 22 POCA applied. Represented defendant. The prosecution appealed the ruling that the application was unjust. Held: lawful for the prosecution to appeal such a ruling but upheld the judge’s decision;
    • Powys CC v Powell MTCC 2018: prosecuted three week fraud against leading counsel. Allegation of tampering with TB tests by farmer. Case involved complex issues of fact relating to the symptoms of TB. Six expert witnesses instructed;
    • NRW v Bayliss CCC 2018: three day contested POCA hearing for EPA 1990 offences. Prosecuted case since inception four years earlier. Prosecution sought in excess of £2m benefit;
    • Cornwall County Council v Cooperative Group Limited Truro CC 2017: prosecuted a multinational corporation following the death of a customer who slipped on water left in an aisle as a result of a broken freezer. Prosecution under the Health and Safety at Work Act against leading counsel resulted in a significant fine;
    • Sir Hugh Pennington’s Inquiry into the e-coli 0.157 outbreak in South Wales 2005 (2008): headed the legal team over a nine month period and conducted all advocacy at two months of oral hearings as counsel for Merthyr Tydfil County Borough Council, one of four core participant local authorities at the inquiry into the second largest UK outbreak of e-coli 157 in 2005;
    • Caerphilly County Borough Council v Jeff White Motors Ltd (2005) EWCA Crim 3003: decision on the scope of admissible evidence in a local authority prosecution of a large South Wales based used motor vehicle dealership.
