In February the Court of Appeal handed down Judgment in Secretary of State for Business, Innovation and Skills v PLT Anti-Marketing Limited, in which it gave guidance on what would be material information for the purpose of Regulation 6 of the Consumer Protection from Unfair Trading Regulations 2008. The Court did not, however, determine what was and was not material information in specific circumstances of that case, finding that this was a matter for the trial judge after consideration of all the evidence.
