The question of how to approach rescission has taken on renewed importance due to the large volume of motor commission and loan commission currently being issued . The 2021 Court of Appeal decision in Wood v Commercial First, and the subsequent High Court decision on quantum, have been extensively relied upon by claimant solicitors.

This talk will review the case law on how to correctly value rescission claims, explore alternative approaches to that set out in Wood v Commercial First, and discuss whether rescission can be ordered if goods hired or sold cannot be returned.
