Julian Gun Cuninghame obtains permission to appeal to Court of Appeal

Julian Gun Cuninghame obtained permission to appeal to the Court of Appeal against the decision of Mr Justice Thompsell in Ratnasingham v Hunt and Kent Property Estates Ltd [2025] EWHC 202 (Ch). This is a second tier appeal from an order of His Honour Judge Parfitt in the County Court at Central London. Granting permission to appeal, Falk LJ stated that the appeal clearly raised a point of principle in the law of tracing as to the extent of backwards tracing and subrogation. Julian Gun Cuninghame is instructed on a Public Access basis in the Court of Appeal. He was not instructed in the Courts below. The appeal is likely to be heard in early 2026.
