Julian Gun Cuninghame acting on a Public Access basis has succeeded on behalf of the landlord in obtaining permission to appeal to the Supreme Court in Edwards v Kumarasamy [2015] EWCA Civ 20 [2015] 2 WLR 1408. This case is important for a landlord who is a tenant under a long lease and lets out a flat on a short lease. It concerns such a landlord’s repairing obligations of the common parts of the building and whether the tenant under the short lease is required to give the landlord notice of disrepair of the common parts. The appeal is likely to be heard in 2016.
