George Spence-Jones – Lenders breathe a sigh of relief – in Breeze v TSB [2026] EWCA Civ 32, the Court of Appeal held that section 140A(5) CCA 1974 precluded an order being made under section 140B(1) in relation to a regulated mortgage contract irrespective of whether that RMC was the “credit agreement” or the “related agreement”.
